The Company will treat any information provided by you in the application process in accordance with our Privacy Policy. For the avoidance of doubt, the Privacy Policy will be deemed fully incorporated into these Terms.

Purchases of Membership or Services

To purchase membership or services, you will be required to provide an authorized credit card, debit card, or other electronic payment method.

You represent and warrant that you have the authority to use any payment method in connection with any purchase and the information you supply is true, correct and complete.

You agree to update your payment information as required from time to time.

All payments shall be processed through a third-party service. We are not responsible for the retention or safety of your billing and personal information collected by such third party service providers.

Fees

All fees will be automatically billed to your payment method until your membership has ended or services have been delivered.

We reserve the right to change or modify fees at any time in our sole discretion without notice.

Cancellation and Refunds

You may cancel your Membership at any time with thirty (30) days written notice to help@thecxoaccelerator.com.

No refunds will be offered for quarterly Memberships or other Services (which are not Membership.)

If you have prepaid for an annual Membership and cancel, you are entitled to get a pro-rated refund of your annual Membership fee based on the lesser of (i) the remaining membership period less 30 days; or, (ii) 8 months.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Westchester County, NY.

Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Dispute Resolution

You agree that all disputes between you and JourneyCxO will be resolved through binding individual arbitration.

Damages and Limitations of Liability

To the extent permitted by law, neither the Company nor its personnel shall be liable for any indirect or consequential damages arising from your access or use of the site or services or any part thereof.

In the event that the Company or its personnel are determined to have any liability, the extent of that liability will be limited to the lesser of one thousand five hundred dollars ($1,500) or the amount you have actually paid to the Company over the prior twelve months.

Changes 

We reserve the right to amend this policy from time to time without prior notice to you.

  1. Membership Application or Information: If you apply for Membership or for more information on Membership through submitting a form or talking with us or our employees/contractors, we ask that you provide us with the following personal information:

  • LinkedIn profile

  • Functional expertise, professional goals and reasons for interest in the Community

2. Billing and Payment Information:If you are offered Membership and choose to purchase Membership or other services, we will collect billing information. We use third party service providers to process payments. We do not store any of your personal information. However, the third party processors may retain some or all of your billing information in accordance with their privacy policies.

3. Event Audio and Video - We may record the audio and video of our live events including Members and panelists. The purpose of these recordings is to allow Members who are unable to attend the events live to access the recordings at a future time. We will provide information to all parties in an event if such event is being recorded.

4. Testimonials - We may request certain Members to provide testimonials about our services for general marketing purposes.

Personal Data We Do Not Collect

We do not collect any sensitive personal information such as (but not limited to) social security numbers, ethnicity, age, religious beliefs, sexual orientation, and political beliefs.

Opt-Out

You may opt-out of any communications from us (newsletter and other content) by sending an e-mail to help@thecxoaccelerator.com or using the unsubscribe link in any relevant communication.

Sharing of Personal Data

  1. Third Party Software Services: We will share some of your personal information with third party software providers for the purposes of providing and improving our services. These software providers may include:

    1. General IT providers (of e-mail, calendaring etc.) such as Google and Mailchimp

    2. CRM providers such as AirTable and Hubspot.

    3. Chat and Messaging platforms such as Slack.

    4. Knowledge Management platforms such as Guru.

    5. Video conferencing platforms such as Zoom and Google.

    6. Payment processing platforms such as Stripe.

  2. Event Sponsors: We may from time to time choose to work with sponsors to offer specific events to Members. In exchange for sponsorship we may provide your name, email address and LinkedIN profile address to such sponsors.

Storage and Transfer of Personal Data

We may store or transfer your personal information (through the use of third party software services or other means) outside the country where you reside

Sale of Personal Data

We do not sell your personal information to any third parties.
